This document outlines the general terms of sale and online payment through the website www.irmedical.es (hereinafter referred to as “the website”), which is owned by:

These general terms (hereinafter, “general conditions”), unless expressly agreed otherwise in writing, govern the relationship between IR MEDICAL and the customer for purchases made through the site.

These conditions are valid from the moment the customer accepts them during their navigation on the site, which constitutes acceptance in accordance with Article 1341 of the Civil Code. IR MEDICAL reserves the right to modify the content of these general conditions at any time, which will apply from the moment of their publication on the site.

Purchase Mode

The acquisition of products is made through access to the site and customer registration.

The customer may exclusively purchase the products listed in the electronic catalog published on the site and available at the time of the order, as described in their respective product information sheets. The characteristics (sizes, weights, colors, functionalities) should be considered approximate. Images may differ from the final product due to screen settings, lighting, or manufacturer updates.

All information provided to support the purchase is informative and does not replace the specific features of each product.

IR MEDICAL will confirm the receipt of the order via email to the address provided by the customer. This confirmation will include an “order number” useful for any subsequent communication with the company. The customer is committed to verifying the data provided and communicating any errors or modifications in a timely manner.

The confirmation message does not constitute legal acceptance of the order. IR MEDICAL reserves the right to accept or reject the order, even after its receipt. If, for any reason, it is not possible to process the order, the customer will be informed by email.

Contract Conclusion

All products offered on the site are subject to availability and confirmation. The contract between IR MEDICAL and the customer will be considered formalized only after the express or tacit acceptance of the order, and in any case, once the corresponding payment has been made.

Acceptance can be tacitly understood with the shipment of the product. The order confirmation message does not imply final acceptance.

IR MEDICAL will not assume any responsibility, contractual or extra-contractual, for direct or indirect damages arising from the non-acceptance, total or partial, of an order.

By registering or making an online purchase, the customer declares that they have read, understood, and accepted all the instructions provided during the purchase process, as well as these general conditions. Once the procedure is completed, the customer may save an electronic copy or print these conditions as set forth in Articles 52 and 53 of Legislative Decree 1/2007 of November 16 (which replaces Legislative Decree 206/2005).

Prices

The prices of the products are clearly indicated on the website and are expressed in euros, including the applicable VAT.

IR MEDICAL reserves the right to modify the prices without prior notice. The valid price will be the one indicated in the order confirmation at the time of purchase. In the case of promotions or special offers, these will be valid until stocks are exhausted or until the specified deadline.

Shipping Method and Costs

At IR MEDICAL, we are committed to providing our customers with an efficient and transparent shipping service. Below are the conditions applicable to shipping based on the location and purchase amount:

Shipping to the Peninsula and Balearic Islands:

Orders under 200 euros will incur a shipping cost of 6 euros.

Orders over 200 euros will receive free shipping.

Intra-Community Shipments:

For orders under 500 euros, the shipping cost will be 50 euros.

Orders over 500 euros will have free shipping.

Shipping to the Canary Islands and Non-EU Destinations:

Shipping costs will be calculated based on the volume and weight of the package.

It is important to note that local taxes and customs duties are not included and will be the responsibility of the buyer.

Warranty

Limitation of Warranty and Liability

The warranty does not apply to damages caused by negligence, incorrect use, and installation not in accordance with the warnings and instructions in the user or installation manual, nor to damages caused by misuse, deterioration due to lightning, weather phenomena, overvoltage, insufficient or irregular power supply. It also does not apply in the case of adaptations or modifications, or damages resulting from incorrect use or contrary to technical and/or safety measures. The installation of technical products must be carried out by specialized personnel and/or professional operators in the field. Specifically, a warranty limitation is established for all perishable products that do not function properly due to causes that cannot be definitively determined, linked to external factors (e.g., voltage regulator batteries that do not charge or overcharge, improper use of battery maintainers, incorrect use by the user, etc.). In these cases, only the manufacturer’s warranty will be valid. Goods that do not meet warranty requirements after inspection will be returned to the customer at their own cost.

Right of Withdrawal

In accordance with Article 64 of Legislative Decree No. 206/2005, the customer has the right to withdraw from the purchase contract for any reason, without the need to provide an explanation and without incurring any penalty, unless specified in the following sections.

Applicable Law and Competent Authority

These General Conditions are governed exclusively by Spanish law.

In accordance with Article 63 of Legislative Decree No. 206/2005, any dispute arising in relation to these general conditions shall be resolved by the Court of the customer’s place of residence or domicile, if residing in Spain.
